# Terms of Service

Please read these Terms of Service ("Terms") carefully before using the **Cafe Pomo** mobile application ("the App") operated by Cafe Pomo ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

## 1. Use of the App

Cafe Pomo is a productivity application that provides Pomodoro-style focus timers with a cafe-themed experience. The App is intended for personal, non-commercial use.

You agree to:
- Use the App in compliance with all applicable laws and regulations.
- Not attempt to reverse engineer, decompile, or disassemble the App.
- Not use the App for any unlawful or prohibited purpose.
- Not attempt to exploit, hack, or manipulate the App's in-app currency or reward systems.

## 2. Accounts and Data

The App does not require account creation. Your data (preferences, session history, achievements, and in-app currency) is stored locally on your device. We are not responsible for data loss due to device failure, app deletion, or other circumstances beyond our control.

## 3. In-App Purchases and Subscriptions

### Premium Subscription
The App offers a Premium subscription that provides additional features including ad-free experience, premium themes, and bonus rewards. Subscriptions are processed through the Apple App Store or Google Play Store.

### Payment and Renewal
- Payment is charged to your App Store or Play Store account upon confirmation of purchase.
- Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
- You can manage and cancel subscriptions through your device's account settings.

### Refunds
Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.

### In-App Currency
The App includes a virtual currency ("coins") that can be earned through completing focus sessions. Coins are used to unlock content within the App. Coins have no real-world monetary value and cannot be exchanged, transferred, or refunded.

## 4. Intellectual Property

All content in the App, including but not limited to artwork, music, sound effects, text, graphics, logos, and software, is the property of Cafe Pomo or its licensors and is protected by intellectual property laws.

Background artwork is credited to individual artists within the App. All music and audio assets are used under appropriate licenses.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes.

## 5. Advertisements

Non-premium users may be shown advertisements provided by third-party ad networks (Google AdMob). We are not responsible for the content of third-party advertisements. Ad frequency is limited to provide a reasonable user experience.

## 6. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:
- The App will be uninterrupted, secure, or error-free.
- Any defects will be corrected.
- The App will meet your specific requirements.

## 7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CAFE POMO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

## 8. Termination

We reserve the right to terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

## 9. Changes to These Terms

We may update these Terms from time to time. We will notify you of changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after changes constitutes acceptance of the updated Terms.

## 10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
